Terms and Conditions for Pre Registed vehicles supplied from UK Carbroker only.Note:These Terms and Conditions will NOT apply for brokers deals that come direct from UK main dealers as your contract will be with the dealer.

You have visited the ukcarbroker.co.uk Website the Website and wish to purchase a Vehicle the Vehicle subject to these terms and conditions. 

1.Orders

1.1 Your order of a vehicle from this website is an offer by you. The company will only accept an order from you when you have signed and returned a purchase order in accordance with these terms and conditions. All orders are subject to the acceptance of the company which is dependant upon the availability of the vehicle being ordered, price changes, and cleared funds of your deposit. 

1.2 If you wish to purchase the vehicle you should read and sign the purchase order form and return to UK Car Broker. By signing and returning the purchase order form you agree to purchase a vehicle of the specification detailed in accordance with these terms and conditions.

2.Prices

2.1 The prices quoted includes VAT, delivery to the dealer, number plates, 12 months road fund licence and first registration fee.

2.2 UK Car broker reserves the right to change the price either before or after UK Car broker accepts any order. UK Car broker shall notify you of such a change and you have the right to cancel your order if the change is not acceptable, in which case your deposit will be returned in full.

2.3 Prices on the web site are for information purposes only and do not constitute an offer by us capable of an acceptance by you.

2.4 In the event that any of our vehicles are listed at an incorrect price or are no longer available. UK Car Broker shall have the right to refuse to accept any order from you or to cancel any order received from you based on the incorrect price, whether or not the order has been accepted.

2.5 A brokers fee will be added to all non metallic / Special paint orders to the value on metallic paint for that vehicle. 

2.6 All cars registered on the 4th January 2011 or after will include VAT at the new rate of 20%.The VAT rate is charged at the point of invoice not ordering.

3.Deposit

3.1 A deposit of between 500.00-700.00 will be required by the UK Car Broker depending on the price of the vehicle you are ordering. If your order is not accepted by UK Car broker this will be refunded immediately.

4.Payment

4.1 Payment shall be made by debit card, credit card, cheques or by bank transfer.Please note a 3% charge for credit cards will apply and we do not accept American Express.

4.2 Payment of the balance due on the vehicle must be made in the manner as agreed with UK Car broker.Title will only transfer to you when cleared funds have been received.

4.3 Permission must be given if we are to accept final payment from a third parties.For example finance/ leasing companies.

5.Delivery/Registration

5.1 UK Car broker shall arrange with you delivery of the vehicle to your home or office. While UK Car broker will arrange delivery, the transport company will undertake the actual delivery itself. On delivery of the vehicle you will be required to sign an inspection sheet confirming that you have inspected the vehicle and that it complies with the specification detailed in the purchase order form and that the vehicle is undamaged. If any of the foregoing is incorrect, you will inform UK Car Broker immediately by quoting on the inspection sheet in which case the following will apply

If the vehicle is damaged you will have the option to 

a. Reject the vehicle and receive a full refund.
b. Have the vehicle repaired free of charge in which case we will inform you of an alternative date for delivery.
c. Accept the vehicle and arrange your own repairs at the Companys cost. If this is your preferred option you must obtain three quotations for the repairs and the Company will select its preferred repairer; or you may request the Company to re-order a new vehicle.

If the vehicle does not meet the specification detailed in the purchase order form the Company will refund the monies in full or re-order the correct vehicle and arrange an alternative date for delivery.

5.2 Deliveries are restricted to mainland Britain, however a further charge will apply for deliveries to Scotland.You will be informed in advance of this amount.

5.3 The vehicles supplied by UK Car Broker are pre-registered and you understand and accept that you shall not be recorded as the first owner of the V5/logbook.Please note all vehicle registration papers will be kept for 3/6 months by our suppliers/dealers to secure the discount/fleet terms negotiated by UK Car Broker.Therefore you will not be able to sell your vehicle within this time. 

5.4 The company will make every effort to deliver the vehicle on the delivery date specified in the purchase order. However, delays will occasionally occur and time shall not be the essence of this contract.The company shall not be liable for any damage or loss including consequential loss occasioned to you or any third party arising directly or indirectly out of any failure on the company's behalf to meet the estimated delivery time.

6.Cancellation of Orders

6.1 If you cancel your order outside of the clause 6.4 you acknowledge UK Car Broker will claim the cost of unrecoverable extras fitted to the vehicle, and any reduction in the value of the vehicle. UK Car Broker will be entitled to use the deposit and any prepayment to reduce its reasonable losses.   

6.2 You shall only have the right to cancel your order if there is a delay in delivery exceeding 14 weeks from the date specified in the purchase order form.If you wish to cancel your order under the provisions of this clause you must notify the company in writing. If we do not receive such written notification the company shall be entitled to regard this as a waiver of your right of cancellation. 

6.3 In the event that the Company can source an alternative purchaser for the vehicle our reasonable administration and storage charges will be limited to a maximum of 1,000.00.

6.4 Under the Distance Selling Regulations 2000 you have a right to cancel your use of our services  without charge, therefore the above sub clauses will not apply.This cancellation right ends on the expiry of the 7th day on receiving the goods.You will be required to arrange transport delivery at a cost to yourselves to our depot in Derby and take reasonable care of the vehicle prior to this.When the vehicle is received, you must provide us with all keys, registration documentation, optional extras, equipment accessories and all other documentation and paperwork supplied with the Vehicle.If the car has suffered any damage which was not caused by us, you accept there will be an appropriate reduction in the amount of money to be returned to you or if the car has been made to your specifications or clearly personalised.Please note a further reduction will apply if the vehicle has exceeded 100 miles or move than what is recorded on the handover checklist.

6.5 Please note we do not sell vehicles to UK Dealerships or personal working for them.We have the right to cancel any orders we have taken that fall in to this clause at any time.

7.1 Our website design, lay out, look, appearance and source code, software and all of the material used on our website are the copyright of the Company. All rights are reserved to the Company.

7.2 The Company gives you permission to electronically copy and print in hard copy format any portion of this website for the sole purpose of placing an order with us or for using this website as a means to shop on line. Thus anything which you download and print from our website is for your personal use only. Any other use of any of the materials on our website including modification, publication, distribution or republication in any form whatsoever without having obtained the Company’s written permission is strictly prohibited

8.Governing Law and Jurisdiction

8.1 These terms shall be governed by and construed in accordance with English law.The parties hereby submit to the jurisdiction of the English Courts.

9.Part Exchanges

9.1. Price Quoted
The price quoted in the valuation will be in pounds sterling and will be inclusive of Value Added Taxation (VAT) and including any outstanding Road fund licence.
All prices quoted in the valuation are given in good faith and are derived from a combination of factors including the information supplied by the Seller. The provision of inaccurate, false or misleading data by the Seller will result in an inaccurate valuation which cannot be relied upon by the Seller.
If for some reason an error in the valuation quoted has occurred, ukcarbroker will rectify the price as soon as reasonable practicable after notification of the mistake. No liability whatsoever can be accepted by ukcarbroker for accidental mistakes or errors caused by system failures.
Any significant increase in mileage by the Seller from the date the valuation is provided to the date of delivery of the vehicle to ukcarbroker will result in the valuation provided being incorrect. A revised valuation may therefore be required. A significant increase is defined as 1500 miles or over per month.
The price quoted is valid until the 25th of the given month, therefore we have the right to adjust the valuation of the vehicle subject to next month's Glasses guide know as book drop.
All vehicles must have at least one calender month of MOT at the point of collection or delivery.This clause will still apply if there is a delay in the vehicle purchase. 
UK Car broker reserves the right to change the price either before or after UK Car broker accepts any order. UK Car broker shall notify you of such a change and you have the right to cancel your order if the change is not acceptable, in which case your deposit will be returned in full.
9.2. Payment
The price quoted will be either deducted from your balance or paid separately at the point of collection.This to ensure finance documents or any other payment will not be affected in the event of the customer selling the car privately or mis-describing their vehicle.
9.3 Miscellaneous Items
When the Seller delivers the vehicle, he shall provide ukcarbroker with all the necessary documentation relating to the vehicle such as service record and invoices, V5 (log book), road tax disc, spare keys, manuals etc.
9.4. Vehicles subject to finance
It is the responsibility of the Seller to disclose to ukcarbroker any existing finance associated with the vehicle.
ukcarbroker may agree to settle off the existing finance in lieu of payment (or part payment) of the vehicle to the Seller at its absolute discretion. ukcarbroker has no duty to pay such finance and will only undertake to settle such finance at its absolute discretion.
If the agreed sale price of the vehicle is lower than the settlement figure required to fully settle any related finance, the Seller must pay ukcarbroker the difference between the settlement figure and the agreed sum in advance of ukcarbroker settling off the outstanding balance on the finance. Failure by the Seller to pay such a sum (and put the Company in cleared funds) within 7 days of an agreement will automatically render the contract between the parties terminated.
The Seller remains liable to the finance company in respect to the related finance at all times until the credit agreement has been legally terminated. ukcarbroker does not accept any liability with respect to the related finance at any time or for any reason.
ukcarbroker will use its best endeavours to pay off the settlement sum before or on the due date. However no liability is accepted if payment cannot be made by the due date due to unavoidable circumstances

Note: The trade in value is being offered to yourself is based on the accurate appraisal supplied by you.Non disclosure upon receipt of the vehicle will result in you being charged for any repairs or asked to take the car back at the agreed price.

10 Statutory Rights

10.1 Your statutory rights including any rights you have as a consumer are not affected by anything in these terms and conditions.Third party rights under the Contracts (Rights against Third Parties) Act 1999 are hereby excluded.

11.Waiver

Complaints Handling 

UK Car broker is committed to customer service. Should you have any complaint about the UK Car broker Service, UK Car broker is committed to resolving complaints in a fair and effective manner.

Please inform UK Car broker by email  sales@ukcarbroker.co.uk should you have any complaint about our service.We are committed to acknowledging your complaint within 48 hours of receipt and undertaking all reasonable efforts to resolving it promptly under the circumstances.We will provide you with a time scale for resolving the dispute and keep you regularly updated with respect to our progress.
